One Tap, Big Impact Competition Terms and Conditions 2021

 

  1. PROMOTION ORGANISER  

1.1 The organiser of the One Tap, Big Impact Competition (the “Promotion”) is PayPal Giving Fund UK, a charity registered with the Charity Commission of England and Wales (number 1110538), and with Registered Office at Whittaker House, Whittaker Avenue, Richmond TW9 1EH (PayPal Giving Fund UK”). 

  1. COMPETITION PERIOD 

2.1The One Tap, Big Impact Competition (the “Competition”) begins on 1 April 2021 at 00:00:01 UK time (the “Competition Start Date”) and ends at 12:59:59 UK time on 30April 2021 the “Competition End Date” (the Competition Start Date through to the Competition End Date is defined as the “Competition Period”). 

  1. ELIGIBILITY 

3.1 No purchase or donation is necessary for a charity to enter.  

3.2 The Competition is open to UK-registered charities enrolled with PayPal Giving Fund UK (“Eligible Participants”).  

3.3. Employees (and their families) of PAYPAL GIVING FUND UK and PayPal, their affiliates, subsidiary companies, representatives or agents of those companies and anyone else who may be directly involved with the Competition in a professional capacity are ineligible for the Competition.  Apart from this exclusion from eligibility, PayPal is not involved in the Competition. 

  1. HOW TO PARTICIPATE 

4.1 In order to participate in the Competition, Eligible Participants must: 

a) be enrolled with PayPal Giving Fund UK. Charities must have a PayPal account in order to enrol with PayPal Giving Fund UK (the “PayPal Account”).  The PayPal Account must be in good standing, and the account must not be in breach of PayPal’s User Agreement at any time. 

b) be deemed a small UK charity defined as those charities with an annual turnover of under £1,000,000 (one million) in their financial year ending in 2019 and, 

cbecome a PayPal Giving Fund UK’s follower on LinkedIn and 

d) encourage their supporterto set them as their favourite charity on the supporter’s PayPal account by completing the following procedure: 

  1. Visit https://www.paypal.com/fundraiser/hub and search for their favourite charity; 
  1. Select the Set as Favourite Charity (SFC) link and enter their PayPal account credentials as directed to validate the choice on or before Competition End DateIf the charity is already selected as favourite when the Competition Period begins, it cannot be added as a favourite during the Competition Period.  

4.2 There is no fee for a charity to enrol with PayPal Giving Fund UK. For more information on how to enrol, visit https://www.paypal.com/uk/webapps/mpp/givingfund/home  

  1. LEADERBOARD COMPETITON FOR CHARITIES  

5.1 Charity organisations will be featured on a leaderboardposted at least every Monday (or the next working day in the case of Bank Holidays) in the month of April 2021 on PayPal Giving Fund UK’s LinkedIn page located here: https://www.linkedin.com/company/69861539 The Leaderboardwill feature the top three charities based on the net increase in the number of “SFCs” for each charity. The three (3) UK charities with the highest net increase in SFCs from Eligible Participants at the end of the Competition Period will each win a cash sum (the “Award”).  

SFCs selections made before or after the Competition Period will not be taken into account. 

5.2 UK charity must be enrolled with PayPal Giving Fund UK at the start of the Competition Period to be eligible to enter the Competition.  

5.3 All UK charities enrolled with PayPal Giving Fund UK are eligible for a chance to win an Award. Each registered charity ID enrolled with PayPal Giving Fund UK is considered a separate charity for the purposes of determining the Leaderboard winners (so votes will not be added together from multiple charity IDs), however, only the most successful charity ID per registered UK charity organisation will be eligible for an Award.   

  1.  DETERMINING LEADERBOARD AWARD WINNERS 

6.1 The three eligible UK charities with the highest net increase in SFCmade during the Competition Period will win an Award. 

6.2 In the event of a tie whereby two or more charities in the top three have the same increase in SFCs, the relevant Award will be shared equally between the tied charities.  

6.3 Potential reward recipients are subject to eligibility verification and compliance with these Terms and Conditions.

  1. LeaderboardWinners 

The awards are: 

  • First Place Award of £6,000;  
  • Second Place Award of £4,000; 
  • Third Place Award of £2,000. 
  1. The awards will be made by PayPal Giving Fund UK to the PayPal account the winning charity has used to enrol with PayPal Giving Fund UK.The Awards will be issued within a maximum of 6-8 weeks from Competition End Date. The total retail value of the Awards is £12,000. 
  2. In addition, each winner will also win the opportunity to be featured (non-exclusively: other charities may also be featured) on PayPal’s Give at Checkout for a week between June 2021 and December 2021. This opportunity is subject to the eligibility rules governing PayPal’s Give at Checkout which are: i) PayPal’s availability as a method of payment on the participating charity’s website, and ii) having a UK PayPal account in good standing and not be in breach of PayPal’s User Agreement at any time. Eligibility criteria must be fulfilled before the participant charity can be featured on Give at Checkout. 
  1. NOTIFICATION 

The winning charities will be notified by email, to the email address they have registered with PayPal Giving Fund UK, by 31 May 2021. Charities shall be responsible for ensuring that the contact details associated with their PayPal Giving Fund account are up to date and accurate.   

  1. WINNERS’ DETAILS  

9.1 The names of the winning charities will be available from the 31 May 2021 by request to info@paypalgivingfund.org 

  1. NON-ENDORSEMENT  

 10.1The Competition is open to all small UK charities enrolled with PayPal Giving Fund UK 

10.2 For the purpose of these terms and conditions, a small UK charity is defined as those charities with an annual turnover of under £1,000,000 (one million) in their financial year ending in 2019. 

10.3 The appearance of any UK charity on a Leaderboard, or as a winner, does not constitute any particular recommendation or endorsement by PayPal or PayPal Giving Fund UK of that charity or its work. 

  1. LIMITATION OF LIABILITY 

11.1PayPal Giving Fund UK shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by any entrant or charity resulting directly or indirectly from this Competition. Nothing in these terms shall limit PayPal Giving Fund UK’s liability for death, personal injury or fraud. 

11.2 PayPal Giving Fund UK is not responsible for any lost or delayed entries.  PayPal Giving Fund UK reminds entrants of the nature and limitations of the Internet and are not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Competition. 

11.3 Although PayPal Giving Fund UK will use reasonable efforts to ensure that all information relating to the Competition ("Competition Material") is accurate,  

11.4 PayPal Giving Fund UK is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect the operation of the Competition or the site, including without limitation the accuracy of any Competition Material. 

11.5 ENTRANTS HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS PAYPAL GIVING FUND UK, THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, DIVISIONS, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES AND SHAREHOLDERS (COLLECTIVELY, THE “RELEASEES”) FROM ANY CLAIMS, ACTIONS, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS’ FEES), LOSS OR DAMAGES OF ANY KIND (COLLECTIVELY, “CLAIMS”), RESULTING FROM PARTICIPATING IN THE COMPETITION OR ANY CLAIMS ARISING FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY.    

  1. EXCLUSION FROM PARTICIPATION  

12.1 Any attempt to manipulate the Competition is prohibited and will result in exclusion from participation. 

12.2 If PayPal Giving Fund UK has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, it reserves the right to disqualify that entrant and any related entrants. 

 12.3 PayPal Giving Fund UK reserves the right to disqualify participants who do not comply with these terms or with the PayPal Giving Fund UKUser Agreement and/or any other PayPal Giving Fund UK policies. 

  1. GENERAL 

13.1 At most only one Award will be given per charity organisation.  

13.2 Taxes, and all other expenses not specified herein, if any, are the responsibility of the winner.  

13.3 By entering, entrants agree to be bound by these Terms and Conditions including all eligibility requirements. 13.4 In the event of unforeseen circumstances or circumstances outside PayPal Giving Fund UK’s control, PayPal Giving Fund UK reserve the right to offer an alternative reward of equal or greater value to that of the Award  

13.5 PayPal Giving Fund UK reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside of its control, or in exceptional circumstances.  

13.6 PayPal Giving Fund UKs failure to enforce any terms shall not constitute a waiver of such term or any other provision. 

13.7 By accepting a prize, a winner consents to the use of the charity name, logo, and entry submission for advertising, publicity and promotional purposes by PayPal Giving Fund UK, in any and all media including but not limited to any online announcements, or for sharing this information with the press for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law.    

 13.8 These terms and conditions are governed by the laws of England and Wales. Any disputes arising under or in connection with them shall be subject to the exclusive jurisdiction of the courts of England, subject to any mandatory provisions of local laws.
